This text aims to inform you in the most transparent way about the ways your personal data are collected, the purposes of processing, legal reasons and your rights in accordance with Article 10 of the "Personal Data Protection Law" numbered 6698.

Pursuant to Law No. 6698 on the Protection of Personal Data ("Law No. 6698"), your personal data will be collected and processed by Apollo IoT Yazılım ve Enerji Teknolojileri Anonim Şirketi (Company/Firm) as the data controller within the scope described below.

Sharing Apollo data and forecasts by the CUSTOMER with 3rd parties will be considered a breach of confidential information.

For what purpose personal data will be stored, processed and with whom it will be shared

Your personal data collected; Carrying out the necessary work by the relevant units for you to benefit from the services of the company, promoting the company and its activities, benefiting the relevant persons from the products and services offered by the company,

Ensuring the fulfillment of legal obligations, requirements or requests of judicial bodies or competent administrative bodies, including the protection of the safety of life and property of company employees and visitors or compliance with the rules regarding those specified in this article

Information and documents such as identity, address, age, gender, photograph, address, resume, diploma, qualification certificate, certificate, home-work-mobile phone number, contact information of a relative of company employees and visitors are requested and archived by human resources, personnel and security units,

Contacting you through the communication channels you have shared, conducting and developing business/meeting/leave planning and information processes

Design and/or execution of advertising and/or promotion and/or marketing activities in digital and/or other media,

Design and/or execution of activities to be developed on customer acquisition and/or value creation in existing customers in digital and/or other channels,

Planning and execution of marketing processes of products and/or services,

Planning and/or execution of the processes of creating and/or increasing loyalty to the products and/or services offered by the Company.

The parties agree and undertake to take the same care in protecting the other party's confidential information as they take in protecting their own confidential information. Even during the Contract Term and/or upon termination or expiration of this Agreement, APOLLO IOT 6.3, all information in written, oral, recorded or visual format belonging to the CUSTOMER and its Affiliates regarding the Services, the CUSTOMER, the activities of the CUSTOMER, the nature and fulfillment of this Agreement, data and materials ("Confidential Information") shall be kept confidential and shall not be used or disclosed for any purpose other than for the purposes of the Services without the prior written consent of the CUSTOMER and shall not be shared with any person, administration, institution/organization and/or third parties without the prior written consent of the CUSTOMER. APOLLO IOT declares, accepts and undertakes to protect the CUSTOMER's Confidential Information with the same care it shows in protecting its own Confidential Information. The advantageous tariffs estimated by the Company are valid for the most current pricing and do not constitute forward-looking advice. The routing made is instant and future-oriented artificial intelligence estimation and this estimation is obtained with the data provided by the customer. Apollo IoT Software and Energy Technologies Inc. is not responsible for any changes that may occur due to reasons such as inaccurate or unrealistic data, instant market changes, updates and quotas of distribution companies.

Apollo IoT Software and Energy Technologies Inc. is not responsible for different invoices that may occur due to the fact that the National Price estimates of the estimated tariff and term, Market Clearing Price and Yekdem Pricing, distribution company's price changes are not fixed and unpredictable. Apollo IoT Software and Energy Technologies Inc. is not responsible for electricity transmission interruptions, disruptions, voltage changes in the recommended distribution companies:

Planning and execution of Apollo's commercial and/or business strategies, including;

Managing relationships with business partners.

Ensuring the legal, technical and commercial business security of Apollo IoT and related persons who have a business relationship with Apollo IoT, within this framework;

Follow-up of legal affairs

Planning and execution of the necessary operational activities to ensure that the Company's activities are carried out in accordance with Company procedures and/or relevant legislation,

Providing information to authorized institutions due to legislation,

Creation and follow-up of visitor records,

Planning and execution of emergency management processes,

Realization of company and partnership law transactions,

Planning and execution of company audit activities,

Planning and/or execution of occupational health and/or safety processes,

Realization of risk management of credit processes,

Ensuring the security of company premises and/or facilities,

Ensuring the security of company operations,

Planning and/or execution of the Company's financial risk processes,

Ensuring the security of company fixtures and/or resources.

Your personal data will be processed within the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698.

Information Not Classified as Confidential Information

a) information previously known to a party without any obligation to keep it confidential,

b) information that has become public knowledge through no fault of either party,

c) Information that must be disclosed pursuant to applicable laws or regulations or a court decision or administrative order.

d) Information that has been provided to the Receiving Party by third parties without any restriction on disclosure; or disclosed by the Disclosing Party to third parties without being subject to any confidentiality provision; or independently developed by any employee of the Receiving Party without access to Confidential Information provided by the Disclosing Party; or no longer required to be kept confidential under a written approval given by a duly authorized officer of the Disclosing Party; shall not be included in the definition of confidential information.

e) Consumption data required by Apollo software, sector information, raw material consumption information arising from sector needs, facility square meter information, number of customers, number of rooms, contracted supplier company, information in the electricity bill, billing information will not be considered confidential information for APOLLO IOT. Sharing of this information by APOLLO IOT with SOLUTION PARTNERS, employees, agents, subsidiaries, distribution companies, retail companies, and other customers will not be considered as a violation of confidential information, and APOLLO has no administrative, legal and criminal liability. Sharing the name of the CUSTOMER with the SOLUTION PARTNER is not considered confidential information and APOLLO has no administrative, legal and criminal liability.

Ownership of Confidential Information

Each party acknowledges that its confidential information and its rights in such information are its own property and that disclosure of such information shall not confer any rights on the disclosing party. Each party also acknowledges that the other party's confidential information contains trade secrets and that it has no obligation to provide trade secrets to the other party. Neither party can guarantee the completeness, accuracy, accuracy of its confidential information. APOLLO IOT is not responsible for company information, contract details, notification settings, username and password changes made by the CUSTOMER on the platform. APOLLO IOT may send all kinds of promotional and informational messages to users, taking into account legal and moral values. All rights to the software, databases and documentation belong to APOLLO. This agreement does not grant any intellectual property rights to the CUSTOMER.

To whom and for what purpose the processed personal data can be transferred

Your personal data collected; To maintain commercial activities within the company, to ensure the legal and commercial security of persons who have a business relationship with our company, to ensure the physical security and supervision of our facilities and buildings in internal and external locations, to carry out legal compliance processes, to fulfill financial and financial affairs, to determine and fulfill commercial and business strategies; business partners, shareholders, legally authorized public institutions such as the Trade Registry Directorate, SSI, authorities such as authorities, ministries, judicial authorities, consultants, organizations, parties, company officials, contracted organizations, payment systems organizations, where permitted by the legislation. Within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of Law No. 6698

Precautions to be taken

If either party becomes aware of any unauthorized disclosure of the other party's confidential information, whether negligent or innocent, it shall promptly notify the other party in writing of such unauthorized disclosure and shall use its best efforts to mitigate any damages that the other party may suffer as a result thereof. The CUSTOMER shall not share web-based Apollo Software login information with anyone who is not authorized to access the platform. The production and sales right of Apollo Software belongs to APOLLO, is protected by the Turkish Criminal Code, and unauthorized copying or unlicensed use in any form or manner constitutes a crime according to these laws. For this reason, software and websites cannot be copied, modified, rented, sold, transferred in any way; software and databases cannot be subjected to reverse engineering processes; data from screenshots and databases, even partially, cannot be transferred to other databases; cannot be used in the development of other software, websites, reference sources and the like.

Method and Legal Grounds for Collecting Personal Data

Your personal data is collected through written/digital applications made to the websites, social media, call center, printed form, scanning of judicial records, SSI records, PTT, your browsing movements on the website, channels through which you have been contacted or may be contacted in the future and stored for the legal period. Your personal data collected by these methods may also be processed and transferred for the purposes specified in Articles (1) and (2) of this Information within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698.
