Apollo IoT Software and Energy Technologies Joint Stock Company takes the highest level of security measures to ensure that your personal data is collected, stored, and shared in compliance with the law and to protect your privacy.

This text aims to inform you in the most transparent manner, in accordance with Article 10 of the Turkish Personal Data Protection Law No. 6698 (“Law No. 6698”), about how your personal data is collected, the purposes of processing, legal grounds, and your rights.

In accordance with Law No. 6698, your personal data may be collected and processed by Apollo IoT Software and Energy Technologies Joint Stock Company (the “Company”) as the data controller within the scope described below.

All ideas, inventions, business methods, improvements, patents, copyrights, trademarks, trade secrets, and any other information—whether protected by law or not—disclosed between APOLLO IOT and the CUSTOMER, including all written or verbal commercial, financial, and technical information learned during the business relationship, as well as all offers, requests, final customer information, and communication records, are considered confidential information and trade secrets.

Sharing Apollo data and forecasts with third parties by the CUSTOMER shall be deemed a breach of confidentiality.

Purpose of Processing Personal Data and Sharing

Your collected personal data may be processed for the following purposes:

  • Ensuring that you benefit from the Company’s services and conducting the necessary work by relevant departments
  • Promoting the Company and its activities
  • Ensuring the physical security of employees and visitors
  • Fulfilling legal obligations and responding to requests from judicial authorities or authorized institutions
  • Collecting and archiving identity, contact, and professional information (such as ID, address, CV, diploma, certificates, phone numbers, etc.) by HR and security units
  • Communicating with you via provided contact channels and managing business, meeting, and planning processes
  • Transferring data to IT infrastructures and cloud systems with necessary security measures and archiving it as required by law
  • Managing company operations, HR processes, recruitment, compliance with labor laws, and occupational health and safety obligations
  • Managing administrative processes such as personnel ID card issuance
  • Conducting reporting, analysis, verification, statistical, and scientific evaluations
  • Ensuring corporate security through camera systems, biometric systems, and GPS tracking where applicable
  • Managing legal and commercial relationships with business partners, customers, and suppliers
  • Planning and executing sales, after-sales services, customer relationship management, contract processes, and complaint handling
  • Planning and executing HR processes such as recruitment, performance evaluation, training, and employee satisfaction
  • Managing commercial activities including operations, supply chain, IT infrastructure, finance, and sustainability
  • Planning and executing marketing activities, including personalized marketing, advertising, customer acquisition, and data analytics

Confidentiality Obligations

Both parties agree to protect each other’s confidential information with the same level of care as their own. Confidential information shall not be disclosed, used, or shared without prior written consent, even after termination of the agreement.

Apollo IoT does not guarantee the accuracy or completeness of forecasts. Pricing estimates and AI-based predictions are advisory and may vary due to market conditions, incorrect data, or regulatory changes. The Company shall not be held responsible for such variations.

Information Not Considered Confidential

The following are not considered confidential:

  • Information already known without confidentiality obligation
  • Publicly available information
  • Information required to be disclosed by law or court order
  • Information received from third parties without restriction
  • Independently developed information
  • Certain operational data required by Apollo (e.g., consumption data, invoices, supplier info)

Ownership of Confidential Information

Each party retains ownership of its confidential information. Disclosure does not grant any rights to the receiving party. No warranties are given regarding accuracy or completeness.

All rights related to the software, databases, and documentation belong to Apollo. This agreement does not grant any intellectual property rights to the CUSTOMER.

Transfer of Personal Data

Your personal data may be transferred, in compliance with Articles 8 and 9 of Law No. 6698, to:

  • Business partners and shareholders
  • Public authorities (e.g., Trade Registry, Social Security Institution, ministries, courts)
  • Consultants and service providers
  • Payment systems and contracted institutions

Security Measures

If a party becomes aware of unauthorized disclosure of confidential information, it must immediately notify the other party and take necessary measures to mitigate damage.

Unauthorized copying, modification, or use of Apollo software is prohibited and constitutes a criminal offense under Turkish law.

Method and Legal Basis of Data Collection

Your personal data may be collected through:

  • Websites and digital applications
  • Social media
  • Call centers
  • Physical forms
  • Public records and official institutions

and processed in accordance with Articles 5 and 6 of Law No. 6698.

Examples of personal data include:

  • Identity and contact information
  • Financial and employment data
  • Health and biometric data (if applicable)
  • Energy consumption and billing data
  • Company and operational data

Return of Confidential Information

Upon termination of the agreement, all confidential information must be returned upon written request. Disclosure or use for advertising purposes without consent is prohibited.

Rights of Data Subjects (Article 11 of Law No. 6698)

As a data subject, you have the right to:

  • Learn whether your personal data is processed
  • Request information if processed
  • Learn the purpose of processing
  • Know third parties to whom data is transferred
  • Request correction of incomplete or incorrect data
  • Request deletion or destruction of data
  • Request notification of corrections to third parties
  • Object to automated decision-making
  • Claim compensation for damages

Requests can be submitted in writing or via other legally defined methods. The Company will respond within 30 days free of charge unless additional costs arise.
